Hardware Does disabling SpotPass in settings disable it globally?

I have "Automatic Software Downloads" and "Send System Info" disabled in the SpotPass settings, do these settings govern whether SpotPass functions at all, or do individual games that use SpotPass still use the functionality even with these settings turned off?
