You definitely can't tell by looking at the website, not in any way. So I'm sure no one could be certain about that. Even when you asked someone who just bought one from there, what if their stock changed?

I'm assuming they'd come with either stock firmware or the latest, do they sell in the original box or just the 3ds w/ charger?
It is in Nintendo's best interest to apply the latest Firmware Update to the 3DS before sending it out as its convenient for the end user to not need to update right out of the box and they make sure none can be used with Gateway3DS.

Just get a used one from GameStop, as they should let you check the firmware if you ask.if not, try another GameStop location.
the nice thing about GameStop is that you are 100% guaranteed to get a 3DS with or below the firmware 4.5 as you are the one checking the firmware version. you just may need to try more than one store location to find one.
I did this when I got my PSP 2K back when you needed a Pandora or firmware 5.03 or below to run homebrew and flash CFW. I decided to utilize ChickHEN so I needed to get a CFW capable slim with 5.03 or below.
I mentioned that I needed to check the firmware and the serial of the PSP 2K's first and guy there let me. of course, he also knew why I was checking the firmware and mentioned that he had his friend mod his PSP 1K, and was actually trying to sell me on getting a 1K as its easier to hack.
