if you install the Nintendo Channel and allow it to collect&send data, then yes, they can see it.

Some homebrew or VC games you one eyed pirate. AARGH!

And it wouldn't hurt to install the homebrew channel whilst you're there

AND MOST IMPORTANTLY DO NO UPDATE YOUR FIRMWARE TO 3.3 BEFORE YOU DO IT. If you do this, the hack won't work. Once you have installed the Homebrew Channel though, updating won't effect it and you can load all the homebrew you want.
