Hardware Digital titles and new owner

looking to pass on my 3DS with 7 titles all downloaded from the eShop. One was bought on card, rest were codes bought online. There is no account or NID and in the past, games without a NID were tied to the console and could be redownloaded,
If the new owner creates a NID or uses their existing one from Wii U will the games remain and then be tied to the new account?

If the new owner creates a NNID on it, it should link the games to the NNID. If the owner has a NNID linked 3ds already, they can do a system transfer from their 3DS to your 3DS and the games will link to their existing NNID.

However, if they already have an NNID and setup a new NNID anyway on the console you sold them, the games will be stuck on that new NNID with no way to merge them.
