Hardware Defective left speaker?

Just got the 3DS today and I noticed that my left speaker does not produce sound.
I didn't notice it when playing Street Fighter IV, but when hopping over to Pokémon HeartGold for a bit it was easy to notice.
When battling, the Pokémon on my side don't make a sound (Cry, stat drops, etc.).
I tried Surround and Stereo, but the left side remains quiet.
Any advice as of what to do?

(I used headphones and both left and right sounds came out like normal)

You'll probably have to return it to the store you bought it from. This is a major problem, so they'd have to let you do it (whereas the problem most people have: the loose hinge, is not enough to warrant a return).

I sure do hope the Christ that loose hinge is not enough for a return.
