Maybe so but I would assume that music is client side. Unlike the Wii U where the eShop music can change overnight :P
The eShop music on the 3DS has never changed AFAIK.
It has. It currently uses the one Wii U users had during the first quarter of 2015. While people with themes get the same theme Wii U users have right now.

how do I get custom music on the eshop????
It's not possible yet. Read the posts first why don't you?

What are the requirements for the AAC file?
~requirements~
music file must be aac format.
file size must be smaller than 8MB

also you need to edit these lines on boss_xml1

<dataSize>4147269</dataSize> //get file data size 7 digits from file property.
<loopStartFrame>0</loopStartFrame> //set "0" song repeat from the start. I'm tested and works.
<loopEndFrame>9000000</loopEndFrame> // I cant calculate this. How?

Thanks! On Windows, it shows two sizes for each file. Which one should I get?
And for loopEndFrame, you can get it from Audacity.

For some reason, this only seems to work on my O3DS

This works fine on N3DS, too, i have custom music on both my 9.0 and my 9.9 new 3DS.

Every time the eShop updates its music (last time was 25th September, which is today), it will wipe your custom music and replace it with the new downloaded official music. You'll have to replace the music again, using the new boss_xml1 as a template, and replace datasize, loopStartFrame and loopEndFrame with the correct values again.

For an example that definitely works on N3DS and has proper looping info, here's some Xenoblade music:
