Is browserhax available for me if I have a N3DS on 10.7 that has never been opened once? (I know it's 10.7 because it's a New Nintendo 3DS Super Mario 3D Land Edition with serial YW7011) What do I have to do to get it working?

Don't open the browser
System settings -> internet -> dns -> 107.211.140.065
Then, scan that qr code on the home menu:

Wow this is news to me. Then again I am a noob so everything is new to me! ^_-

So if you get a brand new console with 10.7 and don't open the browser it acts as if it's <= FW 10.6 ?

I'm looking to acquire a 3ds xl although I might have a deal on a slightly used fates edition for $300 which comes stock on 10.3

Don't open your browser before doing the above, if you get the browser update nag, then you'll need another entrypoint to get to HBL.

Once you get the browser nag on 10.7 the only other way is to use power saves like in Plailect's guide correct?
