now i get it is when you get card or program that is not approved by Nintendo but that means that the hackers got to 1.get the game 2.find a flashcard that cant be brick 3.find a way like to deactivate the brick program or authorize the card that is very hard i think em i rong

Without getting an update? no
Without internet? depends on if the update is on a 3ds game cart.
Will they brick a 3DS just because you play some DS games illegally on it? No.

After Doing some calculations, it appears that it will require 279 Days, 6 hours, 30 Minutes and 43 Seconds for the 3DS flashcard to be released
