Hacking Black Screen when closing DS

I noticed recently when closing my DS (stand by modus) and opening it up again it shows and keeps showing a black screen. Happens in games and in the main menu screen.

Any idea what's up with this? Using gateway 3ds (latest) with latest 3ds firmware available.

Using class 10 DS card, no problems loading up games. I apologize if this has been posted before, using Mobile.

Edit: I had something written in here, then I reconsidered it. Sorry about that. I don't really know what can be happening to you. My emunand homemenu sleeps nicely.

Do you give it some time to respond?

Sometimes in emunand for me anyway, I can close the scren and standby doesn't kick in right away, i'm guessing emunand takes a few extra seconds to send the request to the hardware.
