Misc Avoid ban cfw 1.19?

hello people, recently hack the 3ds and I've been investigating how to play online without being banned, I found that from the 1.18, they implemented a security system similar to the nintendo switch that sends nintendo information of the games. because this has worried me since I have the homebrew and others. I have the spotpass deactivated and friends alike to avoid bans. I do not like cheat codes and I'm not interested in playing games before launch. I do not have freeshop and I did not enter eshop. ban for playing backups or pirate.cias and have unathorized .cias? Sorry for my grammar

You probably mean 11.8 and 11.9, as i dont think there is a 1.19.

As for freeshop, you should not worry, since it does not work anymore.
 
I don't use my 3ds much anymore but you should be fine for the most part. I was able to update my 3ds fine without getting banned. I have not played online on any of my backups and I would suggest that you would do the same. Honestly there are fewer reasons to have your 3ds connected to the internet these days. Just keep it disconnected and you'll be fine.

as far as I know the update only affected downloading the games straight from there cdn, aka what freeshop did. and using games that aren't owned on the linked eshop account are still safe to use. I know this with smash as I dumped my cart and installed it. so in Nintendo's eyes I'm playing the equivalent of a pirated game but there system still doesn't detect it

The security measures you talk about only affected how games were downloaded. That meant no more freeShop neither any of those CDN-downloader programs, and that most likely will never change.
It's simple: don't cheat online, don't play games before release, and don't use cheats in free-to-play games to get some, gems or whatever.
If you're feeling a little bit paranoic and you're in fear for your console being banned, just turn off Spotpass and the "Do you wanna share with Ninty info about your console?" thingy.

It's simple: don't cheat online, don't play games before release, and don't use cheats in free-to-play games to get some, gems or whatever.

then this security measure only applies to illegal downloads of eshop or cdn
and not of pages that contain cias?
 
What Nintendo actually added was a security feature that checked the tickets for games being installed via Sleep Mode, but since they've blocked freeShop this no longer matters.
There is no increased risk getting banned on the latest firmware nor is there a decreased risk of remaining on a lower OFW. Just update and you will be fine.
 
It is completely fine to play online. There MIGHT be a very small chance of getting banned. But, if you don't cheat and like you said don't play games before the release you are OK. If you go into settings > Internet settings > spotpass> sending of via info > off no more info will be send to nintendo. Lastly, DO NOT USE ESHOP OR MII PLAZA (Plus the 3DS hacks guide states, "While we believe that custom firmware is safe for online use, there have been online network bans in the past, primarily for cheating and suspicious eShop behavior." GL!
