Hacking 3DS DLC & Flashcart Question

I have a DSTWO flashcart. I was wondering if I can download DLC for the new Fire Emblem game and is it safe to do so. Will I need to update my 3DS Firmware?

If your DSTwo has the latest firmware (NOT EOS) which is 1.19, it should be able to use the eshop and such just fine.
