My 3ds back has recently opened and when I try to charge it the LED will flash irreugularly and not charge.

The charger itself is fine, however.

I mean take the battery out and put the charger on.

Sorry I missed that mistake.
Well ive taken out the battery and now the led isnt turning on.

I have put the charger in

As far as I know, the 3DS will not operate without a battery.
Try a different charger.
Try a different battery.
If you turn on the 3DS while the charger is plugged in, does the indicator on the screen constantly change between “charging” and “using battery power” as well?
Any effect, if you carefully(!) use a little(!) force to push the charging plug into different directions (loose contact)?

It doesnt swap between, even when the led turns on. I have shuffled the charger about and it doesn't change anything aside from the time between each led flash.

The things turns on, so the battery is not completely dead. Unfortunately a brief web search did not bring any really helpful results.
Again, even if you think it’s fine, try a different charger. In some cases it helped.
How far did you disassemble the 3DS? Only the back cover?
Edit: found a similar thing. Sadly no solution.
