okay after the 19 time of replacing my 3DS I finally found the one with no wobble hinge.
but the analog is a bit stiff, mostly the upper left corner.
maybe I have to break it in.

has anyone had this problem?

You do realize the hinge is supposed to have a slight wobble, right? It sounds like you turned 18 systems into used systems just to try to get one that would actually be considered slightly defective for not having the wobble.

Every analog stick has a small break-in period. I have yet to use one that didn't need a few hours of use to become fully comfortable.

My circle pad felt gritty and a little tight at first; but after two weeks of ownership, it's nice and smooth.

*ucking screen scratching remains though

Yeah - you just have to break it in. If it's off (like, if it the circle is in the middle, and the game is reading it as slightly to the left), you can calibrate it with the 3DS settings.

Some people don't want to hear that tho and think Nintendo shouldn't do that.

IMO I think it is truly like that to keep the hinge safe.

I think mine needed some breaking in too. Not sure.

I think a Nintendo rep said the hinge was supposed to be wobbly.

Plus it shouldn't be an issue unless you suffer from uncontrollable shaking or get so filled with rage that you start shaking your system down for answers.
