If your flashcart has an internal timebomb, then no. It won't fix that. If you're using latest Luma, you won't need the whitelist CIA.

It's always been bannable, but yes, there is more of a concern over it. Although, as you mention, bans tend to happen in waves, and I don't recall one happening for quite some time.
