"Sending my console to Nintendo" is something I might do as a kid in the 90s.
Well the thing is from a legal standing (Here in Australia anyways) they can't just confiscate my shit and refuse to send it back to me. If I actually had full oversight of the process and there was transparency surrounding it, I would do this just to understand exactly what they found.

You tampered with your console so you're not the one to be asking questions. Accept your ban and move on.

Does playing a early leak of Super mario maker 2 on emunand and then transferring over the save file over to Sysnand at release date count?

Not false, the unic legal copies that people get before release date are traced, mostly through eShop.

If you have a save before release date and they don't recognize your account as collaborator or betatester it's a proff that you use a leaked and ilegal copy, to use it you should run the leaked image on hacked Switch, it's very simple.

Note that I said "can be a flag", I didn't ensure 100% that are sure ban, but it's easy to trap hacked Switch's.
Save datas dont have anything attached to them and neither do you need to be a collaborator or a beta tester to play a game before release date. Anyone can get a hold of a early digital copy of a game and will be fine playing it without receiving a ban

How did you restore saves in your official clean NAND? If you ran checkpoint while being in a clean NAND then its nor "clean" any more.

Fyi I got banned couple of weeks ago for doing the exact same thing. Even if you do it completely offline, running homebrew and save injection will leave a trace and dirty your clean NAND. I have Lite for online play so it doesn't matter anyway, but still, now I can't play MK8 online on big TV.

Damn, Nintendo really aren't fucking around this time. If I ever get my hands on a second Switch (perhaps a Switch Lite or if I hold out for a potential Switch upgrade), I may end up risking hacking the lesser Switch. But as things stand now, I'm gonna continue to keep my Switch nice and clean, and just continue to use my hacked out Wii U for most my hacked needs. Granted it's not capable of everything that a hacked Switch is, but it's still capable of a lot that keeps me satisfied.

It is known that Nintendo can identify and will bann "hacked" savegames especially with Smash Bros it is a known ban reason.
And yes, even if your savegame is "legit" the moment you restore a save via checkpoint it it considered as hacked

Yeah, a save from pre-release isn't bannable. Street dates are broken all the time and would look foolish for Nintendo to ban someone to have their copy early. Like I got my Xenoblade 2 CE, 2 days early. Why would I get banned for playing my legit game before a street date? :P

Well, it's up to us people to educate people instead :D

Not on your case, because you are playing a legit cartige and they know it, but the first thing that are checked when you have a early save are check your gamecert.

Anyways I don't gona say more about this thread, seems that @CrisFTW don't know how collaboration network works and I don't want to explain nothing to people that calify the info of others as "false and junk".

FYI with Pokemon saves instead of editing and injecting, use lan-play and trade the Pokemon over. I use emunand, spawn what I want then trade to someone to hold for me on lan-play and then return to normal nand on lan-play and receive then in trade.

What i still don't understand is how, seeing nintendo is hunting switch hacking, and having emunand, people still not leaving sysmmc untouched.
Restoring a savegame from an emunand game is not worth the ban imo.

Believe what you want. I'll keep my research to myself and will report my ban if it happens one day. Not gonna be surprised if I can make it to 2 years of no ban on my main switch

Educating people is too much. They read any info one person say about a ban and not believe a word a guy who isn't ban. I'll probably make a quick 1 minute video on how I restore modded saves from EmuNAND to SysNAND and still manage to use them online

Nope it's honestly super easy, you set your connection profile on the switch to the details found at lan-play.com and download their client, you then enable lan mode in the Pokemon options menu (L+R + Left stick) then you're able battle/trade etc with others.

Yeah - exactly was to keep my progress. Didn't wanna lose progress and based on most anecdotes from other people, they all said they did the same thing without getting banned so thought I'd take the risk (couldn't find a single example where someone said they got banned for ONLY restoring saves, and several occasions of people saying that they DIDN'T get banned for restoring saves).

Not sure if that's actually what triggered the ban, however. The ban was shortly after doing the following things for the first time on the clean NAND (the night before):
  1. Udpating my Mii and profile picture (surely this can't be it, unless it somehow triggered identifying the play time mismatch)
  2. Playing Tetris 99(?) which could be the culprit since I downloaded this - maybe it's somehow been mistakenly identified as the 'pirated' game?

Yeah, not worth it for sure. Didn't think the risk for restoring saves was high though (e.g. refer to @CrisFTW's case).

Altogether not too bad of a loss. I've had my switch offline for 2 years up to this point and its been all good, to be honest may save me a bit of time from trying to grind pokemon so perhaps even economical in the long run haha
