Save datas dont have anything attached to them and neither do you need to be a collaborator or a beta tester to play a game before release date. Anyone can get a hold of a early digital copy of a game and will be fine playing it without receiving a banNot false, the unic legal copies that people get before release date are traced, mostly through eShop.
If you have a save before release date and they don't recognize your account as collaborator or betatester it's a proff that you use a leaked and ilegal copy, to use it you should run the leaked image on hacked Switch, it's very simple.
Note that I said "can be a flag", I didn't ensure 100% that are sure ban, but it's easy to trap hacked Switch's.

I use emunand, spawn what I want then trade to someone to hold for me on lan-play and then return to normal nand on lan-play and receive then in trade.

Nope it's honestly super easy, you set your connection profile on the switch to the details found at lan-play.com and download their client, you then enable lan mode in the Pokemon options menu (L+R + Left stick) then you're able battle/trade etc with others.does the "middleman" need costume firmware and the lan play kip?
The tetris game? yes that is it.Yeah - exactly was to keep my progress. Didn't wanna lose progress and based on most anecdotes from other people, they all said they did the same thing without getting banned so thought I'd take the risk (couldn't find a single example where someone said they got banned for ONLY restoring saves, and several occasions of people saying that they DIDN'T get banned for restoring saves).
Not sure if that's actually what triggered the ban, however. The ban was shortly after doing the following things for the first time on the clean NAND (the night before):
- Udpating my Mii and profile picture (surely this can't be it, unless it somehow triggered identifying the play time mismatch)
- Playing Tetris 99(?) which could be the culprit since I downloaded this - maybe it's somehow been mistakenly identified as the 'pirated' game?

Yeah, not worth it for sure. Didn't think the risk for restoring saves was high though (e.g. refer to @CrisFTW's case).What i still don't understand is how, seeing nintendo is hunting switch hacking, and having emunand, people still not leaving sysmmc untouched.
Restoring a savegame from an emunand game is not worth the ban imo.
