Above basically says it all, Can I use emuNand on a banned switch and not homebrew? Or when i use emunand do i instantly get banned? is there a way to use emuNAND without using homebrew in it?

The emuNAND will be a carbon copy of your sysnand, ban and all. If your console is banned to begin with an emuNAND won't help you.
