The operative word here is yet. You and many other people haven't been superbanned yet but superbans are real and have occurred both to public and private console certificates. Remember that bans do not have to happen instantaneously. A lot of people thought they were safe before being banned but were suddenly banned out of the blue. The point is you take the risk of being banned at any point and it does mean you are safe just because you haven't been banned yet. Bans have only started being dished out for a little over a month now. The Switch may have a long lifespan ahead meaning bans can be issued for years to come.
