Only used SX OS, nothing else, disabled everything and updated in OFW.
This sounds bad.. Any nintendo account linked/used on the console or just local account? If a nintendo account used with SX OS did you purchased something from eshop?

So I had to factory reset my system after installing a game via nsp with the wrong cert (my own doing)
Booted into ofw loaded eshop and redownload my titles, I have selected not to send error reports nor does my router allow a connection to the reporting server, still not banned, I also activated sxos via online when I originally bought it.
A ban is probably inevitable but not received one yet.

Haven't been banned yet I've went online few days ago to get Pokemon quest to try out devmenu. Installed devmenu etc messed around so decided to see if i was banned as of now still not banned.
I have SX OS, been on airplane mode since install until I done the above ^. Before going online I loaded a cart that I had, removed sd card and connected the switch, never did anything else online didn't update backups etc.
Also I modded my Stardrew valley save.
So no ban as of yet fully expect it dont really mind if it gets banned never planned to use it to play online anyways.

oh what if this ends up being a little like the xbox 360? that would store details of the last disc loaded so you could play "unsafe" dsics all you wanted while offline, but you would boot a safe/retail disc disc before going online and you were fine.

Interesting man. How long did it take you to get banned? I do the same as you but I only play backup games on my second nintendo account. My first nintendo account I use online.
I don't know about you bums, but when I get banned (and I will) I will just buy a second switch tablet come december along side smash. Both would only come up to about 200$ maybe a bit over. Continue running my BACKUPS on my current switch. My SX Pro is coming in the mail today so... fingers crossed.
People that says you WILL get banned are funny...you can say that about anything...you WILL die, you WILL have an accident, then when it happens I can tell I was right all along. I'm sorry but I don't believe people who got banned always offline with only the SX OS and nothing more. My Switch is STILL online in my bag now, I play everyday, even send a request to Drex for him to see me online while playing but got no answer. I've "modded" 4 Switches, the only rule I gave them was "do not play online multiplayer games, or games that connect with other players for something" as that is the only thing I haven't done. Maybe I'll get banned, maybe not. None of the 4 switches are banned. I'm not defending Xecuter, if this was free or Atmosphere had it, I'll say the same.

I agree with this. There is a difference between saying you WILL get banned and you CAN get banned. Only people who can say you will be banned is Nintendo.
Going to assume this was pointed towards me. I can chalk this up to the improved telemetry within the Switch aka we don't know everything that the Switch identifies. Even disabling error reporting plus clearing logs can still get you banned no matter how safe you play. Add in that we don't know what specific actions can lead to a ban and there's a lot of things we don't know yet about the ban trends. Saying you don't believe the people who were banned for being offline also throws out the 3DS era of banwaves which were just as much random and fear-inducing. Just like back then, there was nothing deemed to be the cause so it was just down to luck.
There are also plenty of people who are doing everything they can to get banned but having been dodging the bullets. These "frequent buyers" are flagrantly flaunting their hacked Switches to Nintendo without nary a ban in sight. What works for you may not work for others. Bans are as consistent as people who haven't been banned; there is no consistency.
