Misc If I play offline on local wireless with my Hacked Switch 1 and then later connect my Switch 2 to the internet, will it get banned?

Let's say I were to connect my Switch 2 to play a game offline on local wireless with my hacked Switch, where the game we're playing on is an unlicensed copy on the hacked Switch and a real copy (not dumped) on the Switch 2. If I were to disconnect my Switch 2 from my hacked Switch, will the Switch 2 get banned if it goes online a while later?

I will ask you this would it be fair if your Switch got banned because your friend brought his hacked switch round to yours and then never told you it was hacked and then you played against him using local wireless.

We both know the answer to that is no it would be rather unfair (And might I add slightly illegal) thus why Nintendo will not ban an unhacked Switch that connects to a hacked switch.

I mean, in all fairness, Nintendo isn't exactly known for operating on the "fairness" principle. Will you get banned? Probably not. Would I be surprised pikachu face if you were banned? Nope.
 
Most likely there's no information on your Switch 2 that would be able to tell Nintendo that you were playing a multiplayer game with a hacked console. Even if there were, it would be extremely bad press for Nintendo if they started banning anyone who even associated (perhaps even unknowingly) with someone with a hacked console, so it's doubtful they'd ban your completely legit Switch 2 even if they knew.

Not only will it get banned, but any other switch your switch 2 interacts withafter the initial infection will also be banned. Your switch keeps a list of switches it's interacted with in it's database that it logs at all times, going so far as to log switches it's even been near a la streetpass, specifically so Nintendo can target and ban hackers. even being in the same room as one is as dangerous as hacking it yourself.

The only sure fire way to prevent this is to physically disassemble your switch 2, disconnect the battery, and only reconnect it *after* putting it back in its faraday cage that you installed around its dock. Ironically, disconnecting the battery wrong will cause a voltage fluctuation, which will burn the efuse that tells Nintendo you hacked your switch.

That is not how that works in the slightest. Where did you even get this from? I have had my hacked Switch with unlicensed games and Switch 2 on and working (not interacting) at the same time several times (again, not interacting), literally nothing has happened. Maybe if you join a room. But physically having them in the same room does literally nothing.

So in short, can they locally communicate and the switch 2 will still work online without risks? Yes or no.

Banned will always only be the console where the piracy happens. Also Switches don´t get banned for being simply hacked, but for piracy.
So when a unhacked Switch and a hacked Switch play locally and the hacked Switch uses pirated games, only the hacked Switch is at risk.
 
I've even transferred .nsp save data from from my Switch 1 CFW emuNAND to my Switch 2 (transferring them to sysNAND first with JKSV and then to the Switch 2 with the save data transfer feature) and I'm not banned.

If that doesn't get you banned then playing multiplayer with a hacked console certainly won't.
 
From my interpretation of NH's list of reasons for Switch bans, local network doesn't use Nintendo's online services, so unless local game was used to unfairly boost online game stats for the unmodded Switch that goes online, there's nothing to be banned over.

I'm specifically referring to bans caused by edited/cheated saves being used in online games, and indeed, that's a form of cheating which causes console bans.
