Quick question about local play between CFW Banned Switch and Switch 2

I've searched this, but most posts about this are between a hacked switch with EmuNAND connecting locally or a legitimate game cartridge. My question is - does anyone know if a Banned Hacked CFW switch with no EmuNand (All hacks and NSP games on the SysNand) connect using a game run using an installed NSP connect locally to a Switch 2 running the same game legitimately with no risk of a ban?
