hey,

some of u might know that me and my team our working a on a Super mario Bros 2 project..

Questions..

1.Can i keep the name "New super mario Bros 2"?
2.Can i use some old mario sprites ?
3.Can i use the sprites with some editing?
5.Can i use some backgrounds with editing or without editing??
6.Can i use a little bit of music from it??

sounds good to me, you should do it. don't let all the "PizzaPastas" deter you from your dreams. do it, and tell everyone! send nintendo a copy they will love it, and probably hire you to develop "game remixes" VISHI SO FISHI TEAM is #1337!!!

Yes the whole lot is copyright infringement, but on the other hand, unless you go into commercial production I don't think they will particularly care

Yes, it's all illegal.

What you have to decide is if that matters to you or not.

If it does, then you should find another project. You may find that there's a certain joy in creating something entirely new from scratch rather than copying things others have created anyway.

On the other hand, if you really want to make this game, then maybe you should just make it regardless of who owns the "intellectual property" or what they think of your stealing it.

Nintendo actually doesn't own the copyright to "Mario." It's too generic of a name.

This is a fangame, so using most of that stuff is all pretty fine. You wouldn't be the first person to make, or even complete a Mario fangame. If Nintendo wrote you a C&D, you'd be the first person to get one! So you'll get some attention either way.
Nintendo wouldn't jump from no action to legal charges, their PR isn't that bad. The next step is C&D letters, which they haven't even started with.

In procedural law, you could even try to slap them with "fair use" since it's just a(nother) fan game and they sent no C&D, like damn. Not to underestimate Nintendo's legal team, but they're more about words than action.



As for good developer practice though, the bigger the game gets and the more it progresses, it should be less and less stuff "borrowed" from Nintendo and more your original work. Just sayin' is all, if you're going to make NSMB2, don't just make NSMB1.
 
The answer to all your questions is no.

You should have done what I suggested already, which was to use the NSMB level editor and distribute a patch.
