Homebrew Question Online only with CFW and themes

How high is the ban risk if I create an Emunand from zero, start it with Atmosphère, and use nxthemes just to change the theme menu?
No NSP installation, no mods, nothing but the themes.
It's worth it?

I think you would be fine, just becuase your not hacking online or causing anything too unregular. But I mean, they are Nintendo so any thing could happen, you are technically still running CFW. Take my words with a grain of salt though, I'm not absolutely sure about how switch bans work. Also you can use 90DNS if your just accessing homebrew and non-Nintendo related stuff.

Well, anybody would tell you there's still a risk, but I've heard people saying that they didn't get banned using only homebrews, but Idk about themes. It's certainly less risky than installing NSPs, that's for sure.

I'd say it's not worth it. I'd only use my console for dumping games or exporting saves, but I know Nintendo will likely ban even for that. they don't know what you're doing with your console, but I bet like sony and microsoft, they assume everyone with the ability to run homebrew is also pirating games.

basically, what I'm saying is it was too big a risk for me, so I only download all games I own, then use cloud saving with nso. I don't really care about anything else, but I'm sure if I did either with homebrew, I'd get banned. I got banned on the ps3 many years ago, and I wasn't even playing any games.

I think by now the risk is kinda ignorable, as long as you aren't using backups or hacking/modding games online. The atmosphere devs do a great job at disabling as much telemetry as possible, so unless nintendo adds explicit checks, that would get patched out fast afterwards, I don't think there is much nintendo can do to detect a switch with CFW.
I don't even remember when I last bootet the stock firmware on my switches, should be some time around atmospheres first releases. I use Atmoshpere with system modules (sys-clk, sys-dvr and tesla) and sometimes also custom themes. I also use some other homebrews, while normaly going online and playing games like splatoon 2, still nintendo didn't ban any of my or my friends switches with CFW yet.

Also if you are just using themes and maybe a few homebrew, I think an emunand might not be worth the work needed to create it. It might even be more riskier if you want to go online while using cutsom themes, since you need to keep the error log in sync if you also want to use the sysnand from time to time.
I never really used an emunand, and don't plan to do in the near future.

If your only planning to use themes. Its pointless to have an emunand. Emunand isn't a ban protection. Its essentially a brick protection. Every thing that's on sysnand when you make ur emunand, will be on ur emunand. The only way emunand is a "ban protection" is if you keep your emunand offline

I daily use a switch with CFW online without emunand since it is possible.
Both with atmo and sx os.
Till you install NSP seem to be fine.
*When I run homebrew I use a second account that never goes online.
Never install nsp or clean stuff like logs.
Never installed OS update with homebrew only used official method.
Never gone online with any XCI. (even if all my xci has my own game certificate.)
So no idea about themes cause I do not use it but if that does not add nsp to the system I doubt it increase the "chance" of ban.

You're safe. You can install themes and they won't detect it. Been running CFW online and even with sys-clk. All safe.

It's not worth it. They can ban just knowing.you run atmosphere, I believe.

I haven't personally, but a buddy got their switch banned after we hacked theirs and they forgot to 90DNS a Wi-Fi they were connecting to. Far as I know, they didn't have any pirated content installed, though that's not to say they didn't install tinfoil or something themselves. I've been worried about it since, even if it's not the norm.

90DNS is cancer. For anyone who recommends it, they should be banned from all forums and discords. That includes a Cinderace lover who believe 90DNS is much better than incognito. With the many methods we have now to block Nintendo connection, 90DNS is at the lowest tier

Its not a belief; its a fact that you have never countered therefore it is true. Regardless of your opinion about Incognito or 90DNS, 90DNS is objectively better.

To be fair to both of you, I had sent him instructions on running incognito, but it was already super late so he didn't actually do it, and I suspect he forgot about it.

On my own switch, I actually use both, because hell if I'm gonna risk any sorta ban when there's other stuff I can do to prevent it lol

Isn't it better to just « delete » your cert with Incognito than using DNS servers that could let some adresses get through if Nintendo chose to set some more ?

No because Incognito does not wipe all information that is still transmitted through Nintendo's servers. Furthermore, it has been 3 years since the release of 90DNS yet Nintendo has never ever added a new address to combat it which even predates Incognito by a fair amount. Therefore the likelihood of this happening in the future is about as likely as an untethered coldboot exploit.

Obviously I can't promise anything, and every day when I turn on my Switch I'm prepared to see that I've been banned, but after being fine for so long I really think it's probably safe. Just don't install .nsps, don't cheat in online games like Splatoon, and don't change your Switch account's profile pic to something custom.

Could sys-clk be flagged as a ‘cheating’ in online games? Overclocking can achieve more stable framerates, which could offer a slight advantage over non-OC’d systems in competitive play

It could but I've played many Nintendo games online which most have anti-cheat system but none triggered any flags. I've seen a downside when downclocking the switch. Some disconnects happen but I can understand when it's trying to load all the players together and 1 player is taking too long to load

i am on sysnad with CFW i play Purchased NSP online since 2018, no Bans, i have Homebrew installed and nsp forwarders for retroarch, no pirated NSP, i have used some cheats online for testing purposes in multiplayer PVE games

i got a second switch with CFW and pirated NSP never went online with it, i did use cloud saves and console still not banned

i am pretty sure that using NSP with Fake Title keys and signatures is a big flag for Bans

I hacked my switch pretty recently and I am doing the exact thing you're doing.

I use it only for modding Smash Ultimate. Without playing online. Are you still unbanned?
