Ubuntu much like Android does not touch the main OS, Horizon, therefore it is impossible to be banned for using it.

Possibly. No one really knows for sure WHAT or WHY exactly Nintendy bans. But to be safe, switching to emunand is your best option for now.

As long as you don't touch stock firmware you are fine. And now that atmosphere "blanks" your serial by default you don't even need to stay offline.

Since MH: Rise is gonna come out soon. Can i play online using cfw (sysnand) i already edit my exosphere and 90dns as of now.
I'm planning to have an online subscription. I know i can still get ban but atleast i can minimize the risk.

Sorry I didn't respond earlier (you didn't quote me in your response). The reason Incognito doesn't block it is because Incognito is only designed to prevent communications with Nintendo's servers. Local play, as the name quite literally implies, does not make use of Nintendo's servers therefore Incognito should definitely not block it.

There is always a risk of getting banned when going online after using CFW/homebrew. You cannot minimize the risk. Utilities such as 90DNS and exosphere do not mitigate the chances; they merely delay the inevitable without a clean eMMC backup to restore.

I see. well i was planning on upgrading my sd card anyway since 128gb is too little for me. might as well use haku33 once i upgrade to clean my sysnand.

Just be aware that someone has been banned after using Haku33 so its possible it may be worse than say a factory reset.

If you have used CFW, then you never really know. You could be banned today, or you could be fine still for years to come. Only Nintendy really knows. Being banned only really stops you from being able to play others online, and stops access to the Nintendy store, that's it really. You still can use other online stuff once banned.

You can check by trying to log into your Nintendo Account on a computer although Nintendo Accounts are very rarely, if ever, banned since you can easily replace those unlike consoles.

Since we assume most people use Atmosphere with patches, its hard to analyze whether patches increase the risk or not. However using any sort of CFW/homebrew is in of itself a risk so keep that in mind as well.

I don't know about the sigpatches themself but if you have non legit app or games on the home menu on your sysnand it's probably a big ban risk yes

you should keep your sysnand clean and do the dirty on your emunand offline with incognito + airplane
