I'm planning on getting the switch v2. I unlinked my account on my old banned switch through ninty's site after ingot banned. Is it OK to sign into the new switch with my account? And also is it OK to test to see if my cart games are cert banned or not?
Currently as far as i know, it is safe. If you didn't get an Account Ban
BUT Nintendo can change their opinion and ban your second switch, expect anything.

I wouldn’t risk it, just take the loss if you ever bought games on the eshop just play the backups on you’re banned switch.

I know a lot of people say you can just link your old account and they are right for now, but just to be safe i would suggest to start clean,

Account bans are rare, most people get a console ban.
But as you said, Nintendo can start banning switches that use the same Nintendo Account as the banned console.

I just picked up a one of the new Switch consoles with the longer battery life that cant in any way be modded as of now. I linked my profile that I had on my modded switch when it got banned. I can say this much for certain, if they ban a new Switch that can in any way be modded because of linking a profile to it, Nintendo will be opening themselves up to some serious lawsuits.

Actually, modifiying a consoles legality depends on the country. BUT you are breaking the User Agreement by modifiying your console. They can do whatever they want to your console and account by then. There have been some account bans but no lawsuit, i wonder why? And fighting against Nintendo should cost a lot of money, you are better off making a new account.

I understand an account ban, but not a console ban on a device that cant be modded.

They did ban ShinyQuagsire's second switch.

You broke the agreement, it clearly states that modifying the switch will break the agreement. They can have legal action against if you broke the agreement.

@Draxzelex This might be of interest to you:

So, recently, a new type of ban has been popping up, that being one that gives you the error code "2124-4517" when trying to access anything online.

Yesterday the Nintendo US Support page was under maintenance, but according to US support pages (as of 8/8/2019), the error is as follows:
(Link: https://en-americas-support.nintendo.com/app/answers/detail/a_id/43652/kw/2124-4517)

qjljjLX.png

However, they got the error text wrong, as it should be: "Network services are temporarily unavailable. Please wait for a while and then try again."
The New Zealand support page has this correct: https://www.nintendo.co.za/Support/Nintendo-Switch/Error-Code-2124-4517-1582204.html

Anyway, it is briefly hinted at that this is a temporary ban being handed out recently, but there is further proof. As somebody who is banned with the above error code, trying to update any game online results in a slightly different error code: 2181-4017

According to Nintendo's US support page:
(Link: https://en-americas-support.nintendo.com/app/answers/detail/a_id/43653/kw/2181-4017)

Wrzkb57.png

From what I can tell, this seems to prove that (seemingly all) recent bans as of this week have been temporary bans. There is no word on how long these are supposed to last, but I might get around to contacting a customer service representative and see what they have to say about it.

On the other hand, I'm not quite sure why they decided to hand out temporary bans as of late, versus the ordinary permanent ban (regardless of the offense). I've seen this ban pop up around GBATemp, Reddit, and various Discord servers as well, so it's definitely a recent banwave.

EDIT: I contacted customer support via Live Chat and I was simply told the same information available on the support page, and then referred to a phone number, which I don't really feel like calling. Images attached below: (excuse my poor communication lol)

I just get an error “can’t connect to the network right now please try again later” for the past 4 days. That’s their way of saying you’re banned?

They're probably handing out temporary bans regardless of the offense I suppose, but I dunno how long they are.

The weird thing about temporary bans, if they are for having dirty traces on your system, wouldn't they just detect and ban you again once the time is up? Are they expecting people to restore clean NAND backups? Or are these only handed out if they catch you online in the act?

Or are these temp bans actually account bans now, so you can't instantly jump to a clean Switch?

Well this is all speculation in the first place because there is no evidence to indicate these are temporary bans until the ban has been lifted indicating it was indeed temporary. As for why make them temporary, as many people have pointed out, banning someone may hurt Nintendo more than help as not everyone who is banned has pirated games but someone who is banned is more likely to pirate. Implementing a temporary ban may be Nintendo's way of giving them a second chance at moving away from CFW/homebrew. However this can be easily abused which is likely why temporary bans are usually never distributed, at least for people who hack their console. Temporary bans are handed out to people who engage in bad behavior online such as disconnecting from matches or "splatbagging".

I mean, the only thing we really have to go off is Nintendo's online support pages, where the error code for trying to update software is labeled as a "temporary ban" for violating the code of conduct, while the main error code's page just hints to it being "temporarily unavailable" due to "abnormal device behavior".

Reading about the hotspot stuff from earlier in this thread, claiming that it connects automatically, it says specifically that the hotspots don't connect automatically and are selectable similarly to other networks on the wiki.

https://switchbrew.org/wiki/Hotspot_List

Could you maybe provide a direct source that it connects automatically @Draxzelex? I'm currently doing some research on the subject and just want to double check.

Funny story about that, although I've been making that claim from time to time, I forgot where I originally heard it from so I tried searching the forum as well as Discord to see if I could find who originally told me about this but I could not for the life of me. For what it's worth, its not in the first post but if it is, I have to edit it out since I can't find my own source for the claim.
