Currently as far as i know, it is safe. If you didn't get an Account Ban
BUT Nintendo can change their opinion and ban your second switch, expect anything.

Account bans are rare, most people get a console ban.

I just picked up a one of the new Switch consoles with the longer battery life that cant in any way be modded as of now. I linked my profile that I had on my modded switch when it got banned. I can say this much for certain, if they ban a new Switch that can in any way be modded because of linking a profile to it, Nintendo will be opening themselves up to some serious lawsuits.

Actually, modifiying a consoles legality depends on the country. BUT you are breaking the User Agreement by modifiying your console. They can do whatever they want to your console and account by then. There have been some account bans but no lawsuit, i wonder why? And fighting against Nintendo should cost a lot of money, you are better off making a new account.

You broke the agreement, it clearly states that modifying the switch will break the agreement. They can have legal action against if you broke the agreement.
Anyway, it is briefly hinted at that this is a temporary ban being handed out recently, but there is further proof. As somebody who is banned with the above error code, trying to update any game online results in a slightly different error code: 2181-4017
From what I can tell, this seems to prove that (seemingly all) recent bans as of this week have been temporary bans. There is no word on how long these are supposed to last, but I might get around to contacting a customer service representative and see what they have to say about it.
On the other hand, I'm not quite sure why they decided to hand out temporary bans as of late, versus the ordinary permanent ban (regardless of the offense). I've seen this ban pop up around GBATemp, Reddit, and various Discord servers as well, so it's definitely a recent banwave.

The weird thing about temporary bans, if they are for having dirty traces on your system, wouldn't they just detect and ban you again once the time is up? Are they expecting people to restore clean NAND backups? Or are these only handed out if they catch you online in the act?

Well this is all speculation in the first place because there is no evidence to indicate these are temporary bans until the ban has been lifted indicating it was indeed temporary. As for why make them temporary, as many people have pointed out, banning someone may hurt Nintendo more than help as not everyone who is banned has pirated games but someone who is banned is more likely to pirate. I mean, the only thing we really have to go off is Nintendo's online support pages, where the error code for trying to update software is labeled as a "temporary ban" for violating the code of conduct, while the main error code's page just hints to it being "temporarily unavailable" due to "abnormal device behavior".
