Homebrew Online Multiplayer and game region

Does playing a EUR version of SSB4 in a NA 3DS changes anything regarding online multiplayer? Does it raise chances of being banned or something like that?

Also, if I install a NA version of that game, will I be able to update it through Nintendo's server? I've seen people say that it should be possible, based on the 'Type 1&2' logic, but I've also seen people say that it shouldn't work regardless of type.

Basically, do I have any reason to go through the hassle that it is finding .cias, just to obtain a NA version of the game?

Nope you will not get banned for playing an out of region game online

And yes you can update the USA version on a usa 3ds.
