But I told them it was preowned. I'm gonna tell them that after my previous switch broke, I got a used switch that came banned without telling me. I transfered my shit onto that console and now I'm fucked.
TL;DR: i lied.
they will say "I'm sorry you got cheated. That's life."

and they will not unban your console.

I'm sorry to bring you bad news, but that's the truth. you have to face it sooner or later.

I've got a question, it is still not known if just making a backup of the nand and updating fuseless, to be able to play splatoon online, is going to get you flagged for a ban right? We'd need more time and info to determine if it is actually a ban cause?

If you're updating without burning fuses by using ChoiDujourNX, then you will get flagged for a ban since it is currently impossible to update to firmware 6.0 offline due to a lack of cartridges with that firmware. However, if you update without burning fuses by doing it officially then rebooting into RCM when the console restarts after installing the update, then we don't know if you will be flagged for a ban or not due to only having a fuse mismatch since no one has been banned for doing so.

if you update fuseless, as soon as you boot OFW to play online, the fuses will be blown

You can tell us, it would be cleaner without homebrew usage, update normally, leave the jig In while updating and keep vol+ pressed while updating until it reboots to rcm, before booting into 6.0 install autorcm and boot hekate with no gamecart update option. Its the cleanest way to go to latest.

Isn't it possible to boot in Horizon via hekate's autoRCM? OR is this also inherently a bigger risk to get flagged for a ban?

Correct. You can do It both via AutoRCM and regular RCM. The only thing the "stock" FW in hekate does is skip the fuse count to allow you to load any firmware. And the fuse check is performed before it boots to Horizon, so you are still on OFW and can play online as much as you want.

EDIT: Also I just want to clarify that when booting through any option in Hekate, the Custom Bootloader skips the fuse check ,ensuring you'll never burn your fuses. Booting the stock option still counts as OFW even if it skips the fuse check.

Is it then correct that the only thing Nintendo can detect is that there is a switch running 6.0.0 whilst not having the correct amount of fuses burnt, and maybe see traces of active autorcm? Even then it's probably unknown still if fuse mismatches get you flagged for a ban I guess.

Wow, 114 pages. That's way to much to read through. What's the verdict? I've been running cfw and installing nsp files for about 4 months, left WiFi on, finally got banned/flagged 2 days ago (error code 2124-4007) I've been waiting for this for 4 months. I suspect the reason for the error code is I was trying to get multiple game maker games to work via layeredfs and most of them crashed resulting in error codes, I bet I had 30 error codes within 2 hours.

Weird. Majority of users were banned before this thread was even created due to LayeredFS yet your ban came 4 months later. I guess its just further evidence that there is no rhyme and reason to these bans as Nintendo just bans users randomly to make it seem like there's no pattern.

LMAO, 4 months for this telemetry activity are a lot, you can consider you afortunally... I know people that recive a instant ban on the first error prompted with Internet connection.

Basically I did everything you would expect a pirate to do. This includes installing nsp files, allowing them to update via official Nintendo switch updater, installing nsp updates manually, using dev menu, tinfoil, all the emulators. I would occasionally open the Nintendo store just to see if I was banned yet. The one thing I did not do was play any game online. After I got all the errors from trying the game maker games, I booted up telltale the walking dead, it tried to phone home to Nintendo and that's when I got the ban/flag error code and message.

I've been using SX OS since FW 5.1, using SX OS 1.3. I'm using SX OS 2.0 now on FW 6.0. I updated a lot of my games throughout the last few months, and still no ban. Always remove WiFi settings and turn on airplane mode before going in SX OS.
