I want to update to 6.0 to play games online, but I am hesitant because I would like to avoid a ban for as long as possible. Obviously doing anything cfw is risky and we don't know for sure what is bannable but I knew that when I got into homebrew. However, I think I have an alright chance of not being banned because I have only used the hb menu for emulators, and never installed an nsp, or anything like that. What are your thoughts?

We don't know what nintendo looks for in the telemetry data. You best bet would be restore your clean nand backup (if you have one, if not then backup your nand now but it will be dirty) then update officially if you want to play online, but even then it's not 100% safe.

I'm using a NAND backup that only ever used emulators and I haven't been banned, but you can't be 100% sure

are you on 6.0? If so, when you updated did you use a clean nand or just update?

I wish I could do that but I didn't know about nands until after I had done stuff so the only on I have is dirty

Ah so either way you're at risk if you go online. As I said we don't know what *exactly* they ban for

I made a backup of my 1.0.0 back in June, updated without burning fuses to 5.1.0 and played online, got TX OS in July and stayed offline, then 2 days ago went back down to 1.0.0 and updated without burning fuses to 6.0.0 and it's been fine
I even have an error in my logs from the homebrew launcher that's been there since June and no issues so far

The key words there are "So far"

I'm pretty sure I have error logs too, so that's good to know

I did the oposite of u, i installed like 5 nsp and play those (offline of corse), i play online in ofw with my original games for months and no ban. Now before i update to 6.0 i deleted the nsps and the tickets with tinfoil, and im playing online for a week and no ban.

Honestly this is why they say in all of the homebrew guides to make a NAND backup as your first step into RCM, so you can restore to it if needed. That way if you ever want to go back to a clean console setup for any reason, you can still do that without risking something. Whenever Smash Ultimate comes out, I'm going to backup all my save games for my backups, and then restore to NAND. Once you do that, I cannot see Nintendo being able to figure out anything from the restoral, etc.

you see, that's all well and good but we don't know what they look for in the bans :)

I have no idea. I saw something that said they might keep an RCM count in the nand, but again, no idea if that is true at all or not.
It would be nice if we could have someone with a high level of Switch knowledge give their two-cents about this situation. It would be nice to know if restoring to my NAND would be completely safe or not.

No high level Switch knowledge, but for the love of god - will those threads never stop? And why put them in the Emulation, HB and Software projects thread? Just to farm eyeballs? Not even in here can you get by without service request heckling.

Also - despite not having high level switch knowledge all of your questions can be answered by applying a little critical thinking.

Are all people using RCM getting banned? No.
Are some people only using RCM getting banned? Probably no.
Could you be banned for using RCM? Small theoretical chance.

Are you loosing something by updating to 6.0.0? Not if you update in a way that will not burn fuses, because you can downgrade. But yes if you do it "the normal way". (Chance of softmod on <= 4.1.0.)

If I restore a nand backup - will my switch be back to the innitial state? Well - yes.

But what about super secret magic sauce, where they can still ban me? Low likelyhood.

But can you tell me? No - because, well - the thing with code you cant read in its entirety (for example because Nintendo made it, and isnt sharing source) is, that you cant read it in its entirety. You are not dealing with certainties, you are handling probabilities.

And for the love of *expletive* - stop delegating risk assessments you have to make, to a random guy on the internet. This is the new exorcism of the internet age. Pater, could you please absolve me from having the risk of doing something, by telling me that its ok? Speak your olden words of absolution, and I'll do as you please... Dear other guy on the internet, take my responsibility away... Take my risk from me... In two weeks time, when no one cares about what that person or another said, I probably will have forgotten who made me do something as well - and by then, hopefully things didnt break.

Because I was freely serviced by someone with high level knowledge. Or so he said.

Also for the love of *expletive* stop telling us the story, where you would want to play - but then, you dont know, if you shoudl update, because you have fomo - but don't know why, because I've heard it 50 times in this forum already. And I'm not even exaggerating.

If I have to hear one more 13-35 year old tell me, that he want to get support to know, if he should update, because he wants to play game - but doesnt know if he should, I'll write you your own "Capn obvious - max lazy" table card for you to use at any family or friends gathering in the future.

Also there is risk in downgrading. (Not much, but there always is.) So have at it.

Also - anyone who finds an actual factual error in this post - please pitch in. Because as I said, so far, this is only applied logic.
-

If you react more positively to a little theoretical exercise, lets try this one.

Lets say N bans 50% of people that do X - so X has a high likelyhood of you getting banned.
Lets say you dont do X, but only Y - does that mean you don't get banned? Does that mean you also get banned?
Lets say you do X, does that mean you get banned?
Lets say X is a combination of things you dont know, but the likelyhood of 50% bans still persists. Can anyone outside of N say what causes a ban?
Lets say many people congregate together and tell us after they did X, they got banned. Lets say X is a combination of things -lets say it differs between people. What does this tell us?
Lets say X is a moving target that changes over time.
Lets say its your birthday, and high level expert has allowed you to change the 50% value to 80%. Feel better now?

I could really use a free beach towel :P
But for seriousness thanks for taking the time to explain your vision of what you see with these kinds of threads.
I'm going to hold off until a new game that really requires it comes out. Going to update without burning fuses of course.
I'll hold off on a few things until the bugs and kinks are worked out, or until I see a few more success stories since I don't have money to burn on another Switch
Thanks again!
