Also - despite not having high level switch knowledge all of your questions can be answered by applying a little critical thinking.
Are all people using RCM getting banned? No.
Are some people only using RCM getting banned? Probably no.
Could you be banned for using RCM? Small theoretical chance.
Are you loosing something by updating to 6.0.0? Not if you update in a way that will not burn fuses, because you can downgrade. But yes if you do it "the normal way". (Chance of softmod on <= 4.1.0.)
If I restore a nand backup - will my switch be back to the innitial state? Well - yes.
But what about super secret magic sauce, where they can still ban me? Low likelyhood.
But can you tell me? No - because, well - the thing with code you cant read in its entirety (for example because Nintendo made it, and isnt sharing source) is, that you cant read it in its entirety. You are not dealing with certainties, you are handling probabilities.

If you react more positively to a little theoretical exercise, lets try this one.
Lets say N bans 50% of people that do X - so X has a high likelyhood of you getting banned.
Lets say you dont do X, but only Y - does that mean you don't get banned? Does that mean you also get banned?
Lets say you do X, does that mean you get banned?
Lets say X is a combination of things you dont know, but the likelyhood of 50% bans still persists. Can anyone outside of N say what causes a ban?
Lets say many people congregate together and tell us after they did X, they got banned. Lets say X is a combination of things -lets say it differs between people. What does this tell us?
Lets say X is a moving target that changes over time.
Lets say its your birthday, and high level expert has allowed you to change the 50% value to 80%. Feel better now?
