its good that they punish this behavior, however, I'm not happy about the chance of a hacked console becoming virtually useless because of it.
They are pretty much mimicking Sony bans at this point. Only minor difference is that Nintendo has separate services for their games and updates.
 
If you never went online with pirated games on your console before the backup. Then after restoring it Ninty will see it as just your console being offline for a while, which is not a bannable offence AFAIK
In the way you phrased it, nope, the CERT of your console (that will be the same in your backup) is banned server side, so after restoring the backup the ban messages will happen again.
If you phrased "if you never ever goes online with you hacked console and then restore the backup" then yeah, this may work if they don't detected what happened while in RCM mode.
 
So, it's confirmed that hundreds of certs have been banned? Damn. That's rough... but fair.

I wonder how many people had used SX OS before getting banned. I'm willing to bet it's close to 100% of them... GG, TX!

You know TX doesn't need internet at all right? From installing SX OS to playing nsp and dlc

If they are stupid enough to connect online and there's no need to. That's what I'm telling you.

... So they chose a riskier method over devmenu? Well damn no wonder I'm still not banned. I believe that the folks who used ReiNX cfw along with tinfoil got hurt more than sx os users using freshop b/c its their only way to play backups
 
All the more reason to keep my Switch offline. If I want to go online for whatever reason, I'll just get another console. This is reminiscent of the Xbox 360 days.
 
This was a logical step for Nintendo. But the scene is moving so fast that I think that we will come to a point to bypass the firmware check. So even newer games will run on lower firmwares.

This can’t work. System updates don’t only patch security holes; they might also introduce new system-level calls and libraries that can make development easier for the game developers. When a game requires a certain firmware version to run, it’s not just to block piracy; the game very likely uses and requires those new features in the firmware.

Yeah, what I meant if you made the backup of the untouched and unbanned console, you're all okay. Of course it won't help if you're already banned.
 
Wow! Nintendo is in full swing. Actively banning people and suing ROM sites. They're pretty much awake now.
Well we shot ourselves in the foot by releasing this freeshop bit. You got folks posting this all over mainstream media like youtube, so it only motivates a reaction. Never liked the idea of downloading NSP's directly to the Switch online in CFW
that was enough to keep me away from it.
 
To be a pedant I do have to bring up the time they banned offline video watching for banned consoles.

Ahh, that's something I never used TBH, other than that was there anything else?

That was another cat and mouse game, ixtreme etc, things have probably come a long way since then though, for security checks anyway
