Its only a guaranteed ban when folks use them online which is the main batch of bans especially from those new to the CFW scene. The whole point of NSP is to install and play them offlineUsing freeshop CDNSP, devmenu or SXOS is kinda a guaranteed ban anyways. Since NSP files began to be the new norm over XCI people have been getting banned left right and centre. User choice to make if they want to use this or not, you will most likley get banned using this.
You need to be online to use this, it downloads the games directly to the switch from the switch

Yup which is why I prefer to set sail on the Black Pearl on my PC for switch content. I know CDNSP is out there, but it doesn't work for me hopefully this or a simplified way will get a PC version soon similar to the WiiU USB Helper app

There was a comparison of the number of Ibuprofen poisonings before and after they limited the maximum dosage per box or per pill (i'll look that up). No limit on the number of boxes you can still buy as many as you want, so people argued it was pointless.

Here we have ketoprofen that used to be prescription-only because of the risk of toxic dosages, but then they halved the dose per pill and sell them in bottles of six pills apiece instead of twenty and it doesn't need a prescription any more. Yes you can buy more than one bottle but people simply don't.
