Sorry for asking this, but why should I consider your report being added? It appears you have not any modifications to your Switch whatsoever. If you have, please clarify otherwise or you will not be counted.

No this is different. This hasn't stopped. 3DS came in batches. And was probably done with lots of strung together data as 3DS was hard to track.

This is an automated VAC with some randomness and thresholding, or at least all of the indications of one. It may still have some degree of verification before bans are handed out but this seems completely automated. It not hitting everyone is logical early on, they want to spook and discourage. They also don't want to make patterns or triggers obvious.
In that case, it might not be fair to make the comparison with only one banwave for the Switch. You can't draw any lines or trends with only one data point. I'll prefer to not make any decisive arguments until the very end. That reminds me, I haven't compared ban/non-ban rates for SX OS users only...

I don't think this is a wave, it doesn't seem to be coming to an end. More like they turned on their VAC and now we're just going to keep getting reports every day.

This is under the assumption that the bans are being reported sequentially. I wouldn't necessarily hop onto GBATemp immediately if I find out I'm banned and then submit a report. Even before that, the bans could have all been issued around the same time and users are just now checking their units for their ban status. I could try asking that but the difference between continuous bans and banwaves do not affect the risk of being banned.

Anyways, that was a very refreshing conversation! Gave me some things to think about that I would never have considered prior. Having as many different opinions on this topic can help us to better ensure we are thinking through this as logically as possible and eliminating the impossible. My only hope is that all this work can reach those who are having second thoughts.

I used Homebrew emulator once or twice while in airplane mode. Received no errors but did wipe error logs to be safe. I also wiped all Homebrew related files off my sdcard before going online.

Thank you for the efforts in this thread, it's been helpful and interesting to follow.
 
There's too many variables to determine why people's Switches were banned. Nintendo could have added some accounts on the high priority banned list simply because they never bought or registered any games. I remember my 3DS was never banned despite doing things that get others banned. I bought ALOT of games on the 3DS before I installed CFW. I could be on Nintendo's VIP list, banning such account from the eShop is bad for business.

Only played game mods (modified Sonic Mania's exefs to get access to dev menu, modified ARMS' music and modified Splatoon 2's exefs to swap Day with Sunset or Night along with the skybox plus swapping the shooting range. Also played with music mods, model mods and text mods)

I'm surprised I haven't been hit yet really.

This should really be on the home page, right above SX OS 1.2 or at least visible with it.

The home is filled with "Layered FS", "SX OS 1.1" "SX OS 1.2" but no mention of Banned anywhere lol. No Mention of Brick code anywhere either.

@Draxzelex Might want to add to the question / report format, if while using a Hombrew App it crashed. as in, pSnes crashes, this generate a specific report /custom error /custom icon on report / something different that triggers a flag, "maybe?"

This can pinpoint user who got stored custom crashes on their systems.

To summarize this report, I have only enabled AutoRCM as part of the “update without burning fuses” guide to update from 4.1 to 5.1 while keeping the option to downgrade back to 4.1. This is the only modification I have made.

I have never booted CFW or SX; only stock via Hekate. I am not currently banned, but will update this post if that changes.

Kinda stupid on nintendos part to ban also people who aren't going online. Those people are likely to buy games and pay for the online sub as they care enough to not get banned. Less money for them I guess.

EDIT: On second thought, this is a brilliant idea, as these people will likely get a 2nd Switch after getting banned! Sneaky Nintendo!

This is a question that interests me. I also have a fair number of games from the eShop as well as physical games. I wonder if there is a correlation between people who haven't been banned and their purchase records.

I only play online with my legit carts or fortnite and go airplane mode when going cfw.
