Yes because the point of being banned is to prevent you from doing other more dangerous things with the CFW such as playing illegal backups or cheating in online games. Its an unauthorized modification to your system and banning people is the result of being safe than sorry.i have an question, so basically if I use the atmosphere to play my legitimate cartridges online I'll be banned for using cfw?

You cannot prevent being banned when you use a CFW or any unauthorized modification to the system. You can mask the attempts, but Nintendo can theoretically unmask whatever is used to hide our tracks which involves into a cat and mouse game. So do not expect there to ever be a CFW that is 100% safe because it is 100% impossible.This brings up the question I'm sure has been asked, but the answer could have changed and 119 pages is a lot to look through:

As it is, it requires time and money to implement checks for anti-piracy and for a team to check the data to implement bans. Delving further may or may not be worth the added time and money for what they are saving. As it is, people who hack their devices are already a small minority of the larger userbase. I see no reason why you would play favorites or cater towards personalizing bans for hackers.That I try to say is "prevent" shouldn't be a ban option for Nintendo.
