Here any illegal drug is illegal including marijuana, they didn't legalise it, however cops won't do anything to you if you have like one joint... What they will do is take the drugs from you and talk a bit to see if you can tell who sell it to you.

And for people that do heroin and that kind of shit they will try to put them doing a recovery program, the health centre give a free replacement for it which I think its called metadona which probably has a similar effect but its cleaner.

Now if you have a certain quantity you will go on court and jail off course.
In my state less than 1/2 an ounce is a $150 fine and probation time but we're getting off-topic. you'll still go to jail for fraud. sure I do fraud but I don't do it at my house. There Nintendo is just helping the consumer. To nintendeo you are stealing. This guy probably knew it and was like eh why not.

But about those games selling online I still see that who commits fraud is the sellers not the unaware customers (unless off course like I said they knew it).

Same way even key selling sites, the first time I bought a game was for a EA game, I was still sceptical how they could sell a game in those key websites at less than half the price. I bought it and all went good, but I called EA support right away and I told them to check my key and I said where I bought it and they said the key was totally fine and no problem buying on that site...

I know buying the keys is different from the accounts with games, but if I never knew about them I would also have bought games for my PS4, I just read in a forum that they are illegal and could lead to a ban, so I never risked, otherwise I would have also bought them...

ps: EULA is a garbage that no one reads:D.

If someone switches your credit card with a stolen credit card and you use it, you'll still be punished.

thats a different thing... However like I said if a unaware user see a legit site selling a game cheaper they will buy it...

I wonder whats the difference of buying a cheap game on a legit site to buy like a used part for your car on ebay from any seller out there and then cops contacting you that the part was stolen, they will not go against you, but will go against the seller. You will not be able to have the part you bought in that case, but you won't be in jail "baned" for it, but the seller will if they catch him...

Now if you know you're actually buying a stolen part\device, you are also part of that problem...

That's exactly what I was saying... In my opinion who committed fraud is the seller unless he had a big red note in the site saying it can lead to a ban...

Because anyone that doesn't know will just buy the cheaper game they can find without even knowing those accounts with games can lead to bans.

Since only the purchased account was breaking the EULA then I don't think it's fair to ban the whole switch.
From a business perspective it would make sense to ban the infringing account and let the customer learn their lesson and continue being able to make legitimate purchases on their normal account in future.

I don't know about Nintendo EULA, but it probably also will state that you can't buy ppl's accounts too...

However those companies know that almost no one reads the EULA so I don't think a ban is a good practice for any unaware person that buys a game cheaper online...

After contacting Nintendo support if they were good they should have unbanned and just deleted the account that he bought and advice not to buy any more accounts with games in the future, and they should have cared more to contact the site who sells them to stop selling accounts.

On PSN when you make a new account it states that you have to protect your account and its data is not transmissible to anyone else other than the person who creates it.

ps: All I can see is that Nintendo is very bad for customers, Sony is also not much good in terms of hardware repais which M$ was beyond great at least on X360, don't now about the Xone as I don't care 4 it...

I suggest contacting Nintendo and telling them where you bought the account as they can go after the site.
Tell them that you've learned your lesson and you'd like to continue using your switch and the eshop correctly

those cheap account are intentionally selling as bait to lure you.
seller either using stolen cc purchase the game or they always will file a "mistake" purchase to get their money back.
it's same method those ppl used for ios/android mobile game cheap mirco-transcation.

take famous supercell coc, bb, cr, etc as example; ppl purchase those "dirty" gem by giving their account to seller, seller purchase the gem with new account(they always use a new account for purchasing gem, since one account can only report "mistake" 1-3 times); after that, they report the transcation as "mistake" later weeks or months. BOOM! your in-game gem amount will get a deduction of what you have been purchse, lots ppl gets a negative number as remaing gem.


In short, DON NOT FALL FOR THOSE CRAP ACCOUNT!

If they claim the money back on them, I'm sure they never loged in in any switch with the account as that leads to a ban right away :).

Last guy here reporting a ban he said he sent a money back for his paypal "by mistake" and nintendo banned him right away :bow:. (No one would escalate it to paypal by mistake, that was well deserved. he fixed the problem after, but nintendo never unban him LOL).

But like I said before if someone falls in these scams, after reporting and showing all proof to nintendo support, they are very bad not to unban the person as like I said almost no one reads EULA and lot of ppl fall on that one and are actually being scammed and even get a ban;)

There is one way around this but until CFW it will forgo your saves. Go buy a new one, maybe with a credit card, swap the systems and return the banned unit. I've been fixing controllers like this since the N64. If you're super worried about the serial number on it then swap the shells on the systems first.

I never said I condoned the store reselling it. Tell them it doesn't charge fully or something and they will RMA it but you get a new system. Most likely his console was banned and not his account so he might be able to recover his purchases too. So Nintendo ends up paying for it and no one gets hurt. What's unethical about that?

I've been developing games for 6 years professionally, how is it people like me selling illegal accounts from China? I make your precious games little boy.

The entire thing about the EULA not being law is 100% correct. Take for example a signed lease for an apartment. Just because you agreed to and signed a 20 page lease full of rules, doesn't mean they are above the law. If you signed the lease saying "I agree not to...." but your state statues say you CAN... the law overrides ANYthing in the lease. Period. You can't be evicted for breaking terms of your lease if the law specifically says something different. LAw is law. No signed document or EULA can override law, regardless of what you agreed to or signed.
