Hacking Noob question before installing haxchi

Hi, I'm about to install haxchi, I have a banned console, I got banned because I bought a game code and it was bought with a stolen credit card; I already know how to get unbanned, I am on 5.5.1 at the moment, blocking updates with the nds I need to buy the nds game, the question is... do I have to update to 5.5.2 in order to access the eshop? I read that if you erase a file the console just won't update, should I do that?

You can run nnupatcher to access eShop without updating

It's all in the noob guide. You can either run the nnu-patcher or update to 5.5.2, it won't make a difference really.

I've done both.
