Could Nintendo be actually watching the data that gets sent for your friends list, like which game you are playing currently? It might be a possibility, right?

My banned console had that option disabled and that obviously didn't work.

Yeah. It could also be that they still receive the data, and they just didn't do anything visible with it. We obviously won't know until we learn more.

By the way, I have no idea if I'm banned or not; I already caused issues with NNID linking by trying to set up a JP emuNAND. :v

If you get an error code when checking Friends List, you're banned.

Buddy of mine who was banned in the past before Pokemon Sun/Moon released has been banned on a separate 3DS that never got banned.

He got banned on an Old 3DS originally, and his New 3DS just got banned.

Is it viable that they're able to just check our sds for the files used by a9/b9s now? If so I wonder whether they'll ever actually check tickets tied to accounts versus eshop downloads and shut down freeshop essentially.

possibly, but I would assume it's more of a combo of spotpass and 11.4 since my 11.2 is perfectly fine.
