Nintendo is suing go-kart firm in Japan

Today, Nintendo made an announcement on its website that it filed a lawsuit against japanese go-kart firm MariCAR. MariCAR has been in business for a couple of years, offering customers to dress up like Mario Kart characters and drive through the streets of Tokyo with Go-Karts. According to the filing, MariCAR infringes the copyright of Nintendo and is in violation of the country's Unfair Competition Prevention Act. Specifically it says that MariCAR's service causes confusion with Nintendo's Mario Kart trademark, pointing out that it provides Nintendo character costumes to customers as well as promote its service with Nintendo's intellectual property.

Nintendo really doesn't want you making money off of their properties. They really should lighten up on some of these things, but they don't seem to have any intention of ever doing that. Having said that, I think Nintendo is pretty justified in this case, especially when you look at that second picture with the blatant Mario Artwork on the front of the business.

This is so blatant it was incredibly obvious they'd be hit by Nintendo. Very stupid choice on their part. It was an obvious scheme to just piggyback off of Nintendo's success and popularity instead of being their own business.

Why the hell hasn't Nintendo thought of doing it and more. Well, at least they'll be having their own Nintendo theme park though I dunno when that's gonna be available.

My guess is lawyers. A small business like this one can take a hit or two over having accidents or just not being very good. But nintendo? One tiny little accident and perception of the brand could tank. Things like this could be very profitable, but are extremely risky. That's why they like to partner with folks that have years and years and years of experience, like Universal.

Nintendo is so sensitive.
Fan-games = DMCA, Go-Karts in MK style = Sue.
I love Nintendo but they're overreacting...
