I think they are more worried to ban people who don't hack or pirate by accident. Only time will tell really but imo it's going to be banned.
Given enough time, Sure. But I'm not certain they'll really put in the resources to do so. But that's my opinion. It could go either way at this point.

The problem with using a public LFCS isn't the possibility of people being banned for using it, but rather one person fucking it up for everyone. All it takes is someone getting banned for something else in order to take everyone else out.

I may not understand this correctly, but if you use a public LFCS, the worst that can happen is that LFCS getting banned, in which case you can just find anothet LFCS to use, right?

Well that is true but the risk is much greater for using method 3 because way more people are using it compared to a small group of friends or 2 people. Nintendo could easily notice method 3 while for method 2 it will take them quite a bit of searching to notice 2 people using the same code compared to more than 100 people using the same code. If method 3 makes you feel more comfortable then use method 3 and enjoy it before it gets banned.
Thing is, Nintendo staff don't individually look through the list of users manually. It's automatic and programmed to search automatically. The only thing they gotta do is manage their own bot and make changes to it. A bot can detect duplicates far better than a human can.
Back when people used private headers, it only took ONE duplicate to be banned. If it's not private and only used by 1 user alone, I'd say it's pretty much public.
But again this is just my own speculation and how I think it works.

Honestly, I agree with you, This is how I view their system as well.

Did Nintendo at least tried to warn/prompt players from going online before the official release date?
They told reviewers apparently to not go online.

Would the bans only happen if the private headers were used online simultaneously, or just from being installed to multiple systems, even if they didn't go online at the same time?

As far as I know, it was only detected when both headers went online at the same time. Every cartridge has a unique header, you can use this cartridge in any 3DS system. So it's all a matter of two being on simultaneously.

I am able to do the second method (I did a system transfer on current N3DS) and have a few questions.

So I would not be able to play games that require NNID (Pokemon Shuffle) anymore on this system?
If I do a system transfer from current N3DS (after unbanning) to another N3DS and import my saves, will there be issues with NNID required games (I cannot/should not reuse the NNID that got me the ban)?
Alternatively, can I set up a new NNID on another N3DS, system transfer and import the saves will I be able to play without issues?

Thanks.

I think you can play it, but you won't be able to check in or use the other NNID features. Simply importing a save from a different console won't get around that limitation.

If you are banned with one LFCS, can you just use another LFCS from an unbanned console and repeat the process?
Probably, but Nintendo could possibly ban "repeat offenders" in a more severe way, so it might not always work in the future. But that's speculation, noone knows for sure.

Clearly, I guess I should have been more specific. I can obviously still play it as it is right this moment, but can't get updates. What happens when I export my save from a NNID required game such as this and import it onto another N3DS with a different NNID though?

All the methods will erase my eshop history, damn no!

I ... just want to transfer Zelda Four Swords and Steel Diver to the N3DS.... with my main banned 3DS as the last resort but people say that it will transfer the ban! (DECIDE THEN!)

Which ...I DID with the 2DS that was totally okay and failed to transfer and both had nothing, the N3DS and the 2DS (I restored the 2DS backup though so is good)
Nintendo maybe got fishy with me also (Transfer not approved) ... I'm stuck... I don't have the money for Legends of Exidia at the moment, and I don't know if, in 1 week, Ninty will scrap the game out of eshop...

:blink::wtf:

Well your only hope their is if a dev releases a new unbanning method. I have been heard that there is a method 4 in the works and it should let you use your nnid.
