and it's gonna really suck for all the people who buy all these 3ds' used from sellers who didn't disclose that it's banned.

They HAVE to let you check it if you ask, it's not in a box or anything buying used, they have no reason not to.

If they don't think to ASk after a huge banwave then it's on them. That's just common sense when it's known second hand places only check functional hardware/software before taking it.

FFS, can't you just wait for a few days to use online features ? You can still play the game offline before that. What are a few days of playing some online features gonna bring you ? You would risk your entire console being banned for that ?

It's not about the online, it's about playing the game on the same day as rest of the world.
And no, it's more out of curiosity rather than anything else.

I'm not assuming anything. I'm saying if you DON'T check it, and buy a banned unit, Nintendo will not help you. It is what it is, the store would be liable not Ninty, and 9/10 second hand have no refund policies.

This is correct, however it is important to note that if you file a dispute with eBay (if you get one there) that the thing you bought does not work as described and is not fully functional, they will side you with you 100% of the time.

Also, the release date for EUR region was confirmed to be on the 23rd long ago. If you try to play before that, obviously you don't respect Nintendo's term. Therefore, don't complain if they ban you.

The law isn't on their side over here if I manage to get a hold of a cart and they ban me for it Still, I wait for the physical once, to lazy to backup saves etc. Still it's a really odd choice to release in 5 days after in the EU on a wednesday when most Nintendo big releases are on Fridays as it is for Japan and the US.

Except for the fact that you can buy the game legit in the EUR eShop right now. Only the physical games come out on the 23rd to avoid cart dumps which already happened.... It's been confirmed by EUR users here. AU/EUR use the same eShop, if one has it unlocked the other does too.

I installed pokemon sun and moon, i played only moon for a while but never went online. When this ban stuff came out i deleted title and ticket for both games. If i download freeshop copy of pokemon sun and moon when it is officially released in US, am i safe from ban?

I know, i have talked about this alot but all these posts are getting me conern about the possibility of a ban. Problem = OCD + Paranoia + no sleep
