2DS** originally EU but when I set it up, set it up with AUS region, I guess I will try :v
Given the two possibilities, I think the safest way is to install Moon in your untouched 2DS after release date. If you unbanned your 3DS using your 2DS files it might fuck up both consoles.

the game is out here.. Think if i call them tomorrow afternoon I can say I was playing it and then started getting an error?
If the bans end up being permanent I think your best bet is waiting a little while and then calling & playing dumb, after the surge of initial pirates calling and feigning innocence subsides and it's more feasible that you're just a victim of some hostile seller of a banned console.

I doubt it will work like that. Just because you have a legit copy now, doesn't circumvent the fact you were online in the same game prior. How are you going to explain that it was your serial number, your MAC and your NNID/Device ID that was connected to the server and then claim you had no idea? They aren't going to go for the old "the dog ate my homework" routine guys. Cut your losses, and wait it out or just deal with it.

+ someone earlier showed a pic from a response from nintendo, which was written as if it was a permaban.
Written by that exact same guy nobody believes because of his terrible reputation for false information in the jailbreak community?

We've already had conflicting reports of "confirmed temporary/permanent" by representatives on the phone by far more reliable sources, this tells us nothing.
