You could hardmod, downgrade to 10.3, downgrade to 9.2, and then setup emuNAND 10.6 to use the eShop.

I'm asking for my friend he is in 10.3
where I'm on a9Lh emunand 10.6 so I don't need it, he needs Eshop access for the Pokemon VC games with the legit cia's

If you mean using eshop through HANS, it is not possible since Nintendo patched that a long time ago (it's now checked server-side and no technical way around it).

Or you mean updating NVer, which in that case Nintendo can't detect it (all they see is a updated 3DS) and even if they did, what would they do, send the FBI to your house?

While you normally can't use HANS to access the eShop on oudated firmwares anymore, you can still do so if you update your system's NVer. (NVer is the 2 digit number tacked on to the end of every recent 3DS firmware version.) Basically, if you use NASA to install an NVer .cia file with a value greater than or equal to the value of the latest firmware, you can still access the eShop (through HANS) plus other apps like Miiverse and Badge Arcade that require you to sign into your NNID (even without HANS). On a related note, updating the Friend Module title to its latest version allows you to use the Friend List utility and play most 3DS games online on outdated firmware.

If you're interested you can find the exact instructions on this Reddit thread. I've been following this guide to keep my 10.3 3DS online since the 10.4 update and haven't had any issues. Going by the guide it should also work just fine on 10.2 to regain eShop access (only on firmware <9.6 are there problems). If you follow this guide, the only stuff I know of that you still can't access afterwards are the Save Data Transfer Tool (useless with Homebrew) and the System Transfer tool. You also might have some problems using "download later" for eShop games and buying DLC outside of the eShop, but it's been a while since I've done either so I might be mistaken on that.
