It was probably updated before you bought it. Check if the Tomodachi Life demo is on it. If it's not, it was updated then formatted.

Well, I thought about it but it seems weird since I bought it new and straight from the store, but anyway, I found another one and it doesn't really matter anymore with the coming support for 10.3 firmwares I guess.. And I didn't notice if Tomodachi demo was installed, I just brought it back to the store when I saw the firmware..

So in light of recent events I feel @marksteele should let everyone know that soon all N3DS's including the XL models will be exploitable/downgradable up to firmware 10.3.0-28 soon due to memchunkhax2

Just like the @mech said, if you're patient enough, every N3DS would be exploitable. So pick whatever cheapest/special edition you can find.

Despite the new exploits coming out soon, I thought I'd leave a serial number. I bought a black New 3DS XL for my sister just for the heck of it, and it was QW1099, on 9.8.

Please mark Hyrule N3DS, QW4057 with 9.9 FW as confirmed. Mine is now 9.2, as downgrade is possible.

Probably 9.5+. It doesn't matter though; all N3DSes can be downgraded to 9.2 now.

It's 9.8/9.9 in the states, so it's probably the same across the pond. Whatever it is, you can be certain of two things: one, you will be able to attempt a downgrade, and two, it will be higher than 9.2 so will have to downgrade it. And that can be a problem sometimes.
