I believe that wouldn't be the case as homebrew has access to nearly any service that a regular userland app has access to, which they do (i.e. Smash Bros). I imagine gaining access would just require taking over a process that already has access to it. From what I can observe on 3dbrew, it seems there's not a lot of work being done on documenting/reversing nfc:u. Only a few functions have been lightly documented (see http://3dbrew.org/wiki/NFC_Services).I don't see it happening

Yeah, a lot of people get confused about that bit of *hax. It's only a possibility due to the fact that *hax works off of launching another app and taking it over to use all of it's services. But since retail apps don't have a lot of higher services like am:u, it's still limited and you can't do things like install CIAs.
