If a game requires a certain firmware to run it will come with that firmware and ask you to update your 3ds when you try to play it, if your 3DS' firmware is lower. This feature is for people who never connect to the Internet. Otherwise when they bought their 3DS they would only be able to play old games, no new releases.

after i download it and it pops up with the message i just said and i say yes nothing happens the program just closes

You need to extract the files, don't start them in the archive.

You need to drag all the files in the 3dnus.rar to a folder or your desktop.

so is this what i do open 3dnus put 9.5.0-23 in title id and EUR in version change it to new 3ds and tick pack .cia then download?
i put the 2 applications from winrar into a folder on desktop. now what do i do?
also what is make_cdn_cia for?

You probably shouldn't attempt to use 3DNUS. Judging by your posts so far you'd somehow manage to brick your 3DS.
Just stay on 9.0.

You need a game update to do that, not a system update.
You can't access eShop to download game updates without the latest system update and GW doesn't support that on the n3DS yet so the only option is to install a CIA version of the update.
What you are trying to do will not let you play Pokemon or Smash online and you're wasting everyone's time trying to get help with it. A classic case of the XY problem. http://mywiki.wooledge.org/XyProblem
