Hacking Error Code 002-0102, Have I been banned?

So any news regarding the ban? Are Gateway or Sky3DS any closer to give an answer to why or how this is happening, what the solution is to avoid a ban and what Nintendo says about it (there was a Japanese statement in another thread, but my Japanese comprehension is non existant)?
You've got the same information as the rest of us. So far it's only people using .3DZ files, public headers, and playing online that are getting banned. Unless Gateway or Sky3DS have a man inside Nintendo they aren't likely to give us any information we can't get here or elsewhere. Nintendo is unlikely to make a public statement on the matter, as it doesn't really affect their legitimate customers. Nobody asking questions except the pirate/hacker communities. Probably on our own with this one.

Why do some of you think a private header is keeping you safe? Surely if Nintendo is starting to care about this they can surely tell if the header you use originally belongs to the game you are playing online with. Same goes with people using .cia's, if/when Nintendo has the capacity to cross reference accounts, those using illegitimate .cia files are gone also. If this really is a crack down, nobody is safe! Take a page from Sony/Microsoft!

Because nobody using private headers has been banned yet. Simple as that. Seeing is believing, and we aren't seeing it.

Nintendo also tends to be well behind companies like Microsoft and Sony in terms of their security against pirates/hackers. We don't know if they can detect anything more than duplicate headers being connected at the same time.
 
Why is there no discussion about the first .cia/headerless .3ds only case?
I've never used a .3dz game but I've used plenty of .3ds and .cia games with Gateway and I've received the message.

Can you visit other online Nintendo services such as eShop and Miiverse: Haven't tried Miiverse, but eShop gives me the message once before letting me continue every time I launch it

Does that ban apply to just that game or every online game you try: I tested Pokemon: Alpha Sapphire (CIA) and Friends List are all I've tested so far.
Okay, this is odd. I have three emuNAND SD cards, FW 9.2, 9.4, and 9.5. I only get the error on my 9.5 SD. I'm going to try updating my main 9.2 to 9.5 and see what happens.
Are you sure you got error code 002-0102 and not a different one? Can you really play online on your other EmuNANDs? I don't think it really matters, but are they unlinked from your SysNAND?
 
Also a fallacy for the same reason as above. If those things were not available for free, people wouldn't suddenly have money available to buy them. Piracy, by its very definition, cannot be stealing. Nor is it "as close to stealing as you can get." Copying is not theft. If I had a device which could copy the physical structure and internal details of any item I pointed it at, I'd use it all the time and walk out of any retail store with my head held high. Corporations would hate me, but it would not be illegal, and it certainly would not be theft, as that would imply a loss of original property.

When it comes to copyright infringement, it's simply a matter of who has the better lawyer(s). It's you vs. the corporation, not you vs. the law.

And they really only ever charge the people who upload/distribute the files. More than half of America would be in jail for downloading this MP3 or that video file, otherwise.

Theres also limits to what a lawyer can do. If you do something like make an exact copy of something that's copyrighted and expect to get away with it, no lawyer in the world is going to win that case for you.
 
As most have state, you're not here in this forum just to discuss homebrew or dev. You know what your intentions were when you bought that card. Not even sure why there is a debate in here about it.

Absolutely they can. Otherwise you're suggesting that the justice system is in fact not impartial. If their lawyer can win a case for them, your lawyer has to be able to win a case for you.

Lawyers, court and out of court settlements, it all revolves around moneyyyyyyyyyy.

This is what one chinese user got from nintendo. It says the console was banned from online service because of using pirated products.
And I opened a topic to collect imformation about ban on tieba. So far, about ten people have reported being banned. And most of them used 3dz to play pokemon.
But there are also guys who only played MH or Mario Kart banned.

Copyright infringement is a civil matter, not criminal. It's usually never brought to court in the first place, unless, again, it's a person who is doing a lot of uploading/distributing of materials. A lawsuit can certainly be winnable for either side, and yes the laws can be be bent pretty far, although I'll agree that they usually bend more toward the side of money (corporations).

You keep telling yourself that if it makes you feel better. If you ever get caught and decide to fight the charges thinking you can win, well, good luck to you. You're going to need it.

If I ever get prosecuted for downloading a few files, then again, that's the day more than half of America is already in jail. In which case, everybody would have bigger things to worry about. Like moving to a country that isn't a ridiculously overbearing police state.

Thats a third world problem that gets fixed.. As most of us live in the first world. our game pirating is a first world problem solution.

(and it would probably also on both examples hugely increase innovation in the products, It makes companies think different, Wow that sounded so apple..)

Also the same would so work for medicine and other practical stuff, Imagine being able to download/copy medicine.

er, isnt that called planting crops? I have no problems with that at all. In fact, I have a peach tree in my back yard so I guess Im "copying food" right now.
