Why people assume it's tied to friendcode and mac address?

I know it's Nintendo, guys, but it's standard procedure to have a unique identifier on each console, like a serial number.

I'd prefer to get you to try it, no offense meant to M.Z. but he registered less than a week ago and has 5 posts and people on the internet like to lie. You've been here a while so have a bit more credibility.

Possibly worked, I clicked on friends tab on GW3D4.5 and it said no Mii Character to add friend codes too. I'm going to make a Mii Character then update to 9.5. Will let you know.

Right well this is weird. I created the Mii, went to the friend screen, It welcomed me, then popped up with the same error code, but after I clicked okay, It carried on taking my through the friend card process. So I've no idea if I'm actually banned or not atm.

I would guess the system doesn't notice these issues and continues it's process.

Well It no longer throws me out of the friends tab after the message pops up but the message definitely pops up. And I stay offline, even though I'm blatantly online. Going to test it with a game but it's not looking good. Sounds like the Mac is banned. No luck in game either.

... Or your serial number....

As far as I'm aware, a serial number is not something that's detected by the console in any way, pretty sure the serial numbers are actually put on after the consoles are made.
That cannot be correct. How would the serial number be enough to link your games when Nintendo transfers your purchases? If the serial was not linked to the hardware then it shouldn't work like that. How would the hardware know it had new software linked to it?

Oh yes they can view your serial number !
Just check your receipts in the eShop, and you will see...

the serial number is actually stored in your nand :p

next test would be donor files to see what happens....and with certain checks disabled, assuming there is no other uniquely identifiable info that the bans are based on the serial number is a fairly sequential code.....which would mean trouble unless they have at least one other identifier to make sure people dont just keep spoofing the serial and getting anyone and everyone's 3ds banned

Wow, so many people in dark around here.
All consoles have a console ID and Mac Address, when a game server bans a person, they blacklist both the console ID and Mac Address.
This the same way Microsoft and Sony does it, there is no reason to expect Nintendo would not follow suit. Its banning 101.

Most of the times they will not ban your Login Account (NNID), because you may have other consoles like Wii-U linked to the same account, and they don't want to lose your business for those other non pirated consoles. This is why Eshop is still available.
The purpose of banning is to force the end user to buy another console and continue to use their services, but without piracy.

To bypass most bans, you need to spoof both Mac Address and the Console ID (very difficult).
There is no reason to keep speculating anymore, everything points to Nintendo having implemented a text book hardware ban, meaning both console id and mac address are blocked forever, best bet is to sell the system and get a new one.

Been watching this thread for a while now, didn't wanna post, but couldn't help myself.

Not very helpful, but personally, if my console winds up getting banned I plan on keeping it as my backup system and just getting a N3DS for online games (mainly MH4U). I just wish they had the smaller system out, dammit >.<
