It's a 3DSWare title, how should it have the update? You can only install it from eShop.

... That's a theme, its not a cart you can buy outside. It COULD mean new jap games will have it.

If so, that is great news!

No, the firmwares on 3ds.essh are the minimum required firmware. While retail games include the minimum required firmware, jumping Mario is a theme that you need 9.0 minimum to even access the theme shop to look at, there is no reason at all for it to include any update data even in 3ds/cia format.

Only if your 3DS internet connection is set. It will never install itself though. At worst you get annoying "pls update" messages.

Will the update download only while in sleep mode or will it occur while playing games? Me thinks it only happens while in sleep mode or if inactive at the home menu. If so avoiding the update prompt should be easy. I'll just keep the wifi switched off on the 3DS and turn it on only when I need to do any multiplayer stuff.

I know it won't when you're playing games, it absolutely does in sleep, and no idea about idle in the home screen
