Play hundreds of games with GW3DS. If you really like Pokemons buy a new clean 3DS to play it Show them how big poke fan you are

If you want to carry on playing new games then I do suggest to get a separate unit just for the Gateway. It's a bit early to tell whether or not sufficient measures will be taken to "shut the cart down" and for now the Gateway can't go Online anyways due to a lock-out, most likely on the cart itself. That, and certain games won't work on it at all due to a custom save file system (like "Animal Crossing: New Leaf") unless the Gateway team comes up with a patch to circumvent that obstacle.
The infrastructure doesn't support banning as of today and would have to be revamped entirely to do so. Hell, it doesn't even support accounts - what are we talking about?
The worst Nintendo can do right now is send you a postcard saying that you've been a naughty boy by pigeon mail, and that's only if you inform them that you're using a Gateway yourself and give them your address, seeing that they don't even have an account system set up yet. There is a certain amount of information that's sent to them as far as system reports are concerned but they have no means to act upon them because "Nintendo doesn't understand Online".
If you're worried about it... oh... I don't know... buy the game legitly?
they could ban your mac address so yes...it IS possible to never be able to use Nintendo WFC again..so thats why it's not recommended to go online with it
if they could do that and if they did would i be able to use other features of online such as the internet browser and is it possible for nintendo to brick my 3ds
I never play Pokemon for the online, but I can see why others would be super upset by 'modded' pokemon and rigged battles. It kind of takes the 'fun' out of the game for those who play online.
I doubt they can block GateWay if you leave the internet off. However, that said, I also hope GW will have an option, in the future, to use the WiFi connection. However, I hope that it blocks edits in the game's code to allow modifiers for pokemon and cheats.

My honest opinion...
Gateway is a no buy... unless you really want to run pirate games...
You can't get banned if you stay offline, and higher-firmware support doesn't matter if you have a compatible unit. The only real flaws you listed is lack of homebrew, no online and no multi-rom.
MAC address ban... lol. as if a MAC address isn't the easiest thing to spoof ever.
