Nintendo is requesting $4.5 million in damages from a Reddit moderator

Nintendo is going after more people who were involved in distributing Nintendo Switch warez and popularizing it on Reddit. A moderator, "Archbox", of the r/switchpiracy subreddit, is being sued by Nintendo for copyright infringement through distributing and hosting pirated Switch games. According to the court document, Nintendo attempted to reach out multiple times to the defendant, named James Williams, to get them to stop hosting "pirate shops" that would allow for seamless illegal game downloads from the Nintendo Switch console directly. Williams also requested user donations to help pay for the costs of hosting the illegal warez. Allegedly, after Nintendo reached out a final time with a cease and desist order, Williams stated a legal counsel would be in contact imminently, to which Nintendo claims never happened.

As a result, Nintendo is seeking $4.5 million dollars ($150,000 per infringement) from Williams in damages to their brand, as he was willfully breaking the law with "reckless abandon".

Hate to say this, but this is another win for Nintendo. This Williams person was showing proof that he wasn't taking into account on what he was doing is going to damage him hard if he didn't comply. There are better ways to get these games through other means, and while developing something to make the process easier is fine enough on its own, one must understand the risks of doing such.

Made especially worse when you think that he was asking for donations to his works. I'll get angry when the big N makes an attempt to stop emulation from existing, but if its to stop random Redditors (or people in general) from taking down easily accessible ways to pirate their games, then that's okay
 
It's another case where you can't really be surprised. It'd be one thing if they actually were just moderating, but to be hosting warez and after having multiple opportunities to remove them..? What did they expect would happen?
 
So this guy was making money off of hosting pirate shops, was told multiple times to stop and kept doing it? Play stupid games, win stupid prizes.

can nintendo/gamefreak sue the us government as well for copyright? bros are going after a reddit mod but not the white house. so they pick and choose who they take to court.
Of course they pick and choose. Upsetting Orange Man risks jeopardizing your entire business in the States - trying to sue the government is massive risk for very little reward.

I've noticed that Nintendo's legal team is doing a much better job at dealing with these kinds of problems after the launch of the Switch 2. I hope that this actually works and that they don't go back to just taking down projects and whatnot.

They got more madder after Satoru Iwata died.

They have no problem to price the game at $70 and sell Switch 2 at higher price, even price hike for Switch 1.

What's fucking greedy company and oh nah, I don't blame on piracy at all.
 
These idiots gotta stop playing with fire with that sort of stuff. There's precedent for Nintendo ruining people's lives over piracy, and nobody's immune to being made an example of.

Still though, 4.5 millions is a ridiculous ask, blasting his ass in court should be enough.
The damage amount should honestly be per copy downloaded, which I doubt amounts to millions.

i would literally laugh in their face cause they cant touch me (you cant collect SSDI for lawsuits) and thats the literal ONLY income i have also inheritance, nah due to what i said i'm off my parent's will

Any lawyer could argue (probably unsuccessfully) that nintendo lost the right to even sue because they refuse to sue the US government
You mean that they didn't want to sue the government that absolutely could have forced the outcome in thier favor through thier ability to just print infinite money to hire a ton of lawyers that already was alighed for the outcome they wanted alone? No... You don't say?

And now the goverment could easily use that as grounds to strip your SSDI if Nintendo did take you to court and win and the only lawyer you'd have being the one they have to give you due to being too broke to pay for one, congrats, you fucking moron.
