How likely will I be banned for playing online with hacked game?

So are there any ways to connect to the Nintendo servers without them having an actual chance to ban me? I am about to mod my switch v2 and set up emuMMC incognito and tinfoil on my SD card and I don't really plan on playing online, just pirate all the great games switch offers but are there ways to do so without high risk of being banned? Playing Mario Kart 8 or smash bros online would be fun but I don't see myself paying money for them...
